Court of Common Pleas. February Term, 1833

EPHRAIM HASTINGS of Heath in the County of Franklin and Commonwealth of Massachusetts, Esquire, Plaintiff, against John D. Haynes, of Epsom, in said county of Merrimack, Butcher, other wise called of Brighton, in the county of Middlesex and Commonwealth of Massachusetts, Defendant. In a plea of the case founded on the note of said defendant under his hand dated the ninth day of February, 1831, for the sum of eight hundred dollars in eight months, and grace, made payable to one Samuel Davis or order and by him endorsed to the Plaintiff. Also, on said defendant's other note of the same date, under his hand for seven hundred dollars in six months, and grace, made payable to Samuel Davis or order and by him endorsed to the Plaintiff.
It has been suggested to the Court that the property of the defendant in said State of New Hampshire has been attached on the Plaintiff's writ and that said defendant has had no notice of the said attachment.
It is therefore ordered that said action be continued to the next term of the Court to be holden at Concord, in said county of Merrimack on the first Tuesday of September 1833, and that notice to be given to the said defendant of the pendency thereof by publishing a copy of this notice and the order of Court thereon in the New Hampshire Patriot and State Gazette, a newspaper published in said Concord five weeks successively the last publication thereof to be thirty days prior to the first day of said Term in September 1833.

EXECUTOR'S NOTICE.
The subscriber hereby gives notice that he has been duly appointed Executor of the last will and testament of JOHN S. HAYNES, late of Epsom, in the county of Merrimack, deceased, testate. All persons indebted to the estate of said deceased, are requested to make immediate payment, and all having claims to present them to the subscriber for adjustment.

WILL OF JOHN S. HAYNES 1850
In the name of God, Amen. I John S. Haynes of Epsom in the county of Merrimack and State of New Hampshire do make and publish this my last will and testament in manner and form following, that is to say:
First I give and bequeath unto my beloved wife Lucy Haynes the sum of five dollars and the whole of my household furniture as long as she shall remain my widow.
2nd I do also give and bequeath unto my son Nathan Haynes the sum of five dollars.
3rd I do also give and bequeath unto my son Jeremiah Hayes the sum of one hundred dollars provided he shall remain at home till he shall be twenty one years of age.
4th I also give and bequeath to my daughter Hannah wife of Benjamin Danforth the sum of ten dollars.
5th I also give and bequeath to my two daughters Mary D. Haynes and Lucy Haynes the sum of five dollars each and to my grand daughter May I. Haynes, five dollars.
6th I also give and bequeath to my daughter Sarah Haynes the sum of five dollars and if she lives with her mother until she is twenty one years of age, fifty dollars in addition.
7th I also give and bequeath to my son George S. Haynes the sum of one dollar. Which said several legacies or sums of money I will and order to be paid to each person named above respectively in one year after my decease if twenty one years of age, otherwise when each of them shall arrive at that age.
8th I further give and devise to my two sons Henry and Benjamin Haynes their heirs and assigns all my real estate situate in Epsom to have and to hold the same to them the said Henry and Benjamin Haynes their heirs and assigns forever, also all the personal estate which I may own at the time of my decease except the household furniture, provided that the said Henry and Benjamin Haynes shall suitably support and maintain their mother in sickness and in health so long as she shall remain my widow and provided further that they support and maintain my sister Mary Haynes and my son Nathan Haynes during their natural lives in sickness and in health on the homestead farm. And further order that each of my sons and daughters have a home at my house as long as they remain unmarried and further will and order all said legacies and all my just debts to be paid out of said real estate by my executor herein after names, and lastly I do hereby constitute and appoint William Ham sole executor of this my last will and testament and hereby revoking al former wills by me made, in witness whereof I have hereunto set my hand and seal this 31st day of July AD 1850. - John S.
