EPSOM PROBATE RECORDS

WILL OF JOSEPH TOWLE - 1828

WILL of Joseph Towle - 1828

In the name of God, Amen. Joseph Towle of Epsom in the County of Merrimack and State of New Hampshire being weak in body but of a sound and disposing mind and memory, considering the uncertainty of this life and being desirous to settle all my worldly estate while I have capacity so to do, do make, ordain and publish this my last Will and Testament, therein and thereby dispose of all my worldly estate in manner following, to wit viz.

1stly - It is my will that my just debts shall be paid out of my estate by my Executor hereafter named.

2dly - I give, devise and bequeath to my daughter Hannah Yeaton one hundred dollars to be paid out of the one half of the undivided farm where Samuel Goss now dwells and occupies which will hereafter be described; one half of fifty dollars to be paid in two years from my decease and the remainder in one year from the first payment.

3dly - I give devise and bequeath to my daughter Susannah Goss one dollar to be paid to her by my Executor in one year after my decease.

4thly - I give, devise and bequeath to my grandson Joseph Goss and Sally T. Goss, children of Samuel and Susannah Goss the full undivided half of that farm or lot of land where their father now dwells and occupies to be equally divided between them after their mother's decease by their paying the one hundred dollars to my daughter Hannah Yeaton which payments are described in the above in article second.

5thly - I give devise and bequeath to my wife Sarah Towle all the rest of my estate whether real or personal whatsoever and wheresoever it may be found to be hers as long as she shall remain my widow and no longer - then after my wife Sarah Towle shall cease to be my widow, it is my will that it shall go to my daughter Sally Hersey and her heirs for them to inherit forever by their, the said Sarah Towle and Sarah Hersey giving to my grandson Haseltine Yeaton his support and privilege in the house as long as he shall remain single and is willing to stay, by his laboring for them during said time as much as his health and strength in reason will admit.

Lastly - I appoint, nominate and constitute James Hersey my son in law, the sole Executor of this my last Will and Testament, ratifying and confirming this and revoking all other will by me heretofore made.

In witness whereof I Joseph Towle, the testator have this thirtieth day of June in the year of our Lord one thousand eight hundred and twenty eight - In presence of us witnesses and in the presents of each other, set my hand and seal to this my las Will and Testament in presents of us. - Joseph Towle
